I think you are confusing two separate issues Fudgely.

The driver was in breach of the law by not stopping to report he had hit the dog.

If you what to point the finger as to whose FAULT it was that the dogs died?

Simple.

Agree with Fudgeley and everyone else who has said any car accident involving a dog the driver has to stop and report the incident to the police - that is a legal requirement.

With regards to whether a driver killing a dog or not after an accident, technically, if their car hits a dog while they're driving it, yes they did kill it.

But is it the drivers fault? That depends on the facts, such as whether they were speeding, driving recklessly, should have seen the dog etc.

(Basically the same sort of investigatory questions we'd ask (to determine 'fault') if a human had been hit and killed.)
