Is it ok for the RSPCA to re-home dogs before court action is compleat?

following on from greyhoundk's thread

I wondered, should the RSPCA re-home dogs prior to any court case being finalised against the first owner,

what would happen, should the first owner win there case?

would the original owner have the right to claim the dog back?

I know someone who got a rhodesian ridgeback which was a court case . He got it first of all on a foster basis and once the court case was won he got it permanently . I agree with that

Absolutely, as long as it is on a foster basis and everyone knows where they stand in the event of a "not guilty" verdict. These things can take months or even years to resolve and the poor dog would be spend a large percentage of it's life waiting in kennels .
