A person can only commit the offence if they have entered and remain in the residential building as a trespasser. Any intentional, reckless or negligent entry into a building will constitute trespass (see Archbold 21-116 2012). This means the offence will not apply to a person who entered the building with permission of the property owner, such as a legitimate tenant.
