Spoken to one of our HR Partners....

You can't just let someone go (for whatever reason) without written advice. Even if it was gross misconduct, the company would still have to write to Barry and tell him why he was being sacked.

Same with redundancy. If the company do need to "let some people go" they have to write and tell you why they're doing it, and how the selection was made.

The key here is getting something in writing - if they haven't written to him; they are in trouble. CAB should be able to help you with this.

I'd go so far as to not mention the "in writing" bit to the company, let them get themselves into trouble....

Baz spoke to Steve (the supervisor) this morning tio get a clearer picture as to "why".

Steve said he was laying Baz off. Baz said you can't lay me off because you have loads of work. You're either making me redundant, and you can't as you have loads of work, or you're sacking me, and I want it in writing.

Not sure/can't remember what Steve's response to that was.

So sorry to hear this Vicki, I know the rotters are going to get their come-uppance in the end, but its just a pain in the neck having to deal with it all in the meantime.

I don't have anything constructive to add, sounds to me like the advise you've already received and discovered yourself is spot on. Just wanted to say best of luck to you both. xxx
