Can anything be done on a rescue that do not assess dogs, have them
vet checked, neutered or vacd etc.?
Iv spoken to someone about this rescue that rehomes dogs/cats & have been told that the animals there have nothing done to them & the place is dirty & they are more interested in taking money for them?
They do no home checks & this person signed a bit of paper stating that anything happens after you take a dog they are not liable....is this just something to put of the public for them not to challenge the rescue on this?
Have you seen an animal needing veterinary treatment at this place? Because under current legislations, that is the only thing that place could be prosecuted for. Under the Protection of Animals Act 1911-2000. If veterinary treatment is being withheld, then this would be a strong case of causing 'unnecessary suffering', and as such you would need to phone the RSPCA emergency helpline.
The Pet Animals Act 1951 requires anyone 'selling' dogs to have a license issued by the local authority. If this place asks for a
minimum fee for an animal and do NOT hold such a license, then they are breaking the law. Contact the local authority and see if a license has been issued to this place. Inland revenue would be no doubt be interested too
The Pet Animals Act 1951
The Pet Animals Act 1951 (as amended in 1983) protects the welfare of animals sold as pets. The Act requires any person keeping a pet shop to be licensed by the local authority. Before granting a licence the local authority must be satisfied that the animals are kept in accommodation that is both suitable and clean; that they are supplied with appropriate food and drink; and are adequately protected from disease and fire. The local authority may attach any conditions to the licence, may inspect the licensed premises at all reasonable times and may refuse a licence if the conditions at the premises are unsatisfactory or if the terms of the licence are not being complied with.
Local authorities are responsible for enforcing the law in this area and anyone who has reason to believe that a pet shop is keeping animals in inadequate conditions should raise the matter with the local authority who will decide what action to take within the range of its powers.
Under s.2 pets cannot be sold in the street, including on barrows and markets, and under s.3, pets are not to be sold to children under 12 years of age. (Ref: DEFRA)
The Animal Welfare Bill as you probably know, has lots of provisions in place for this kind of problem, but from what I've heard, its going to be next year before that passes and becomes law
