Dogs which savaged sheep in Pilling avoid death sentence

Two dogs which killed and savaged sheep at a Pilling farm have escaped the death penalty in a bizarre turn of events.

The Rottweilers ripped open the throats of ewes with lambs during the attack at Skronkey Farm, which was described by a vet as " The worst case of sheep worrying I have seen."

In a bizarre twist it was revealed that the two dogs responsible can not be put to death because the section of the law under which their owner was prosecuted does not give the courts that option.

Brett Chappell, defending, today told a court that the section of the law under which his client had been prosecuted did not allow for the dogs to be destroyed. He asked for Holden's previous plea of guilty to be withdrawn.

Mr Chappell said he now intended to consult the Crown Prosecution Service as to whether his client could be given a conditional caution instead of being prosecuted. This would entail Holden paying the farmer compensation for the loss of his sheep.

I am not sure what to think about this. The owner of the dogs had previously pleaded guilty to being the owner of a dog which worried livestock when it was thought the dogs could be put down, but now it is found that this cannot happen wants the plea to be withdrawn.

There has been an increase in sheep worrying incidents in recent years. So much so that the largest farming paper, the Farmers Guardian, has started a campaign to educate dog owners about the risks to ewes, lambs and other livestock of having dogs off lead around them.

I personally think that there is a case for farmers to use lethal force, ie to shoot a dog worrying stock, if there is absolutely no other way of preventing the dog from continuing an attack. However, I do not agree with ordering a dog to be destroyed after the event. If the owner is caught and prosecuted, then I believe a hefty fine and being ordered to pay the value of the sheep who were killed/had to be put down would be appropriate, as well as an assurance that the dogs would be kept on leads and/or muzzled around livestock in the future or a stiffer penalty regarding the dogs would be considered.
