He's wrong.

The Dangerous Dogs Act 1991 would not be applicable in this incident because it was private property.

The owners could still be prosecuted under the Dogs Act 1871 but that would require showing that the dog was both 'dangerous' and 'out of control' which is harder than 'dangerously out of control'. One incident is not usually sufficient.

thats what i thought too...

i find it suspicious that there are so few details... but a 'gathering' could easily overwhelm a dog, and if that is the case i really hope the poor dog doesnt suffer. also, the owner of the dog should have prevent such a situation.
