Hoping to pick someone's brain if possible

Hi*

I'm hoping to pick someone's brain. My neighbour is in a pickle, she has a Bichon and due to work commitments 3 months ago made an agreement with a person for them to look after her dog full time, the dog live with them on the provision that once a month she has him back for a full weekend. The dog would always remain hers, she still pays his insurance, his vet bills etc. Now here is where her dilemma comes, this lady has now gone back on this agreement and won't allow her to see him, this person has tried to change his microchip over which she succeeded in doing until my neighbour questioned it and it's now been reverted back to her name with Petlog as it was done fraudulently.

She was talking to me about it tonight and was wondering what her next steps would be as it's a civil matter according to the police. This had me thinking of when I was part of Hope rescue the clause we had in the adoption agreement of basically if the adopter doesn't abide by the agreement then hope rescue has authority to take the dog back.

Does anybody work with rescues so would know how a rescue would go about it, or anyone know in general what happens when someone goes back on an agreement with a live possession etc, would you go to a solicitor?, what would you say?, is it through county courts etc that allows you to cease the dog.


She's very distraught at the moment as she's now worried that she's never going to see him again, so I'm trying to help in anyway I can.

What a horrible situation not sure if Trevor Cooper is it would be worth approaching.

There are some guides down the left hand side saw something about ownership so might be worth a try and they have a help line.

Hi Sarah what a dilemma. Unfortunately as they say 'possession can be 9/10th of the law' and it could be difficult to get back possession of the dog without taking civil proceedings.

Was anything put in writing or was this a verbal agreement, I am guessing the latter.

It could also be argued logically (harsh at it seems) that as the previous owner only has the dog back for a weekend once a month he is better off with the other people if they are treating him well.

It certainly does need sorting out particularly if your friend is still paying to support him.

If doing so I would write down the relevant
points keeping them as concise as possible while still including the main details and read them off on the phone.

Tbh if he was mine and I wanted him back I'd just go and get him, and take no nonsense from his minder, cheeky cow.
Does the owner have proof of purchase, she obviously has his vet records, he is chipped to her, go and get him because what the other woman is doing is stealing him.
If I put mine in kennels I don't expect them to refuse to hand them over when the time is up and I can't see this arrangement is too different tbh but it can not be allowed to continue.

What a truly dreadful person this person is to go back on a agreement involving a very much loved pet belonging to your friend. To get the microchip changed is beneath contempt, and the police. who wash their hands of the matter are not much better.
If I were your friend I would fire off a Solicitor's letter demanding the immediate return of her little dog . Failing that, I would hire two burly blokes (worth every penny to get her dog back) wait until she is walking the dog and just take it back and be damned! If the police are unwilling to get involved on your friends behalf then stuff them by doing the above ! After all, if as they say, it's a civil matter, take her chances in a court of law and see what happens.
