Perhaps the bigger question should be not who should prosecute, but why judges are being totally ridiculous when sentencing?

The Judiciary is obviously at fault, it falls within their powers to give longer custodial sentences and far bigger fines.
The answer is surely not to give the RSPCA powers of arrest (which would mean recruiting a much diferent type of Inspector) but to consistently campaign for a harder line to be taken with offenders.
